Terms of Service

1. Agreement to Terms

By accessing or using Punchlistify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, including Realtors, Contractors, and visitors.

2. Description of Service

Punchlistify is a two-sided marketplace platform that connects real estate professionals ("Realtors") with service contractors ("Contractors") for property maintenance, repairs, and punch list work.

We provide:

  • A platform for Realtors to post job listings
  • Tools for Contractors to find and bid on jobs
  • Secure payment processing and escrow services
  • Communication tools between parties
  • Review and rating systems

Important: Punchlistify is a marketplace platform only. We do not employ Contractors, supervise their work, or guarantee the quality of services provided.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription and Fees

Subscription Plans

Access to certain features requires a paid subscription:

  • Realtors: $29/month for unlimited job postings
  • Contractors: $19/month to browse and bid on jobs

Platform Fees

A platform fee (approximately 5%) is charged on completed job payments to cover payment processing and platform maintenance.

Billing

Subscriptions are billed monthly in advance. You authorize us to charge your payment method on file. Fees are non-refundable except as required by law.

5. User Responsibilities

All Users

  • Provide accurate information in profiles and listings
  • Communicate professionally and respectfully
  • Comply with all applicable laws and regulations
  • Not engage in fraudulent or deceptive practices
  • Not circumvent the platform to avoid fees

Realtors

  • Provide accurate property information and job requirements
  • Review completed work promptly (within 7 days)
  • Pay for services through the platform only
  • Provide fair and honest reviews

Contractors

  • Maintain appropriate licenses and insurance
  • Complete work as agreed in a professional manner
  • Communicate any issues or delays promptly
  • Accept payment through the platform only
  • Provide accurate information about qualifications

6. Payment Terms

Escrow System

When a Realtor accepts a bid, payment is collected and held in escrow by our payment processor (Stripe). Funds are released to the Contractor only after the Realtor approves the completed work.

Payment Release

Realtors have 7 days to review completed work. If no action is taken within this period, payment may be automatically released to the Contractor.

Disputes

If a Realtor is unsatisfied with the work, they may file a dispute before approving payment. Our team will review the dispute and work with both parties to reach a resolution.

7. Prohibited Activities

You may not:

  • Use the Service for any illegal purpose
  • Harass, abuse, or threaten other users
  • Post false, misleading, or fraudulent content
  • Attempt to circumvent platform fees
  • Scrape, crawl, or harvest data from the platform
  • Interfere with or disrupt the Service
  • Impersonate another person or entity
  • Use automated systems to access the Service
  • Attempt to gain unauthorized access to our systems

8. Independent Contractor Relationship

Contractors using Punchlistify are independent contractors, not employees of Punchlistify or the Realtors who hire them. Contractors are solely responsible for:

  • Their own taxes, including self-employment taxes
  • Obtaining necessary licenses and permits
  • Maintaining adequate insurance coverage
  • Providing their own tools and equipment
  • Compliance with labor and safety regulations

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We do not guarantee the quality of work performed by Contractors
  • We are not responsible for disputes between users
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees paid by you in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless Punchlistify, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Work performed or services provided through the platform

11. Intellectual Property

The Service and its original content, features, and functionality are owned by Punchlistify and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit but grant us a license to use, display, and distribute that content as necessary to provide the Service.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • At our sole discretion for any reason

Upon termination, your right to use the Service ceases immediately. Any pending payments will be processed according to our payment policies.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation, if negotiation fails
  3. Binding arbitration as a last resort

You waive any right to participate in class action lawsuits against Punchlistify.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes constitutes acceptance of the modified Terms.
